Introduction and Acceptance
Welcome to Optouts (the “App”). These Terms of Service (“Terms”) govern your access and use of the App and related services. By installing, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree, do not use the App.
Eligibility
You must be at least 13 years old to use the App. By creating an account, you affirm that you meet this age requirement.
Account Registration & Security
You agree to provide accurate, complete information when creating an account and to keep it updated. You are responsible for maintaining your account confidentiality and are liable for all activities under your account.
License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
Subscription, Payments, and Refunds
- All payments, including subscriptions and in-app purchases, are processed exclusively via Apple App Store or Google Play Store.
- You are responsible for understanding the payment terms imposed by the applicable app store.
- No refunds are offered for any purchases, subscriptions, or renewal fees, except as explicitly required by applicable law or dictated by Apple or Google’s store policies.
- Subscription and billing management, cancellation, and renewal must be handled directly through your chosen app store.
Acceptable Use
Users must comply with all applicable laws and must not:
- Misuse, hack, reverse-engineer, or disrupt the App or its functionality.
- Post, share, or transmit unlawful, harassing, threatening, or abusive content.
- Violate intellectual property or privacy rights of others.
User-Generated Content
You are responsible for all content you submit, post, or share on the App. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your user content for App operations and improvement. We reserve the right (but are not obliged) to review, flag, and remove content that violates these Terms or applicable law.
Account Suspension & Termination
We reserve the right to suspend, restrict, or terminate access to your account or the App for violations of these Terms, legal requirements, or suspicious activity, with or without notice.
Intellectual Property
All App content, trademarks, and software are owned by Optouts or its licensors, protected by copyright and trademark law. No right, title, or interest is transferred to you other than the limited license expressly granted under these Terms.
Limitation of Liability
- The App and its content are provided “as is” and “as available”, without warranties of any kind.
- Optouts is not responsible for relationship outcomes, emotional consequences, or reliance on suggestions, data, or content within the App.
- To the fullest extent allowed by law, Optouts disclaims liability for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the App, including the conduct of other users or third parties.
Disclaimers
- Optouts does not provide professional counseling or legal advice.
- We do not warrant uninterrupted, error-free operation or that the App is compatible with all devices or operating systems.
- The App may link to third-party sites and services. We are not responsible for their policies or actions.
Modifications to Terms and the App
We reserve the right to update these Terms and/or modify the App at any time. Revised Terms will be posted on the App or website. Continued use after changes signals acceptance of the updated Terms.
Governing Law
These Terms are governed and interpreted in accordance with the laws of Virginia, without regard to conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of the courts in Virginia.
